මං සදාකාලිකව ඉන්න ආවේ නෑ.. තනතුරේ වැඩේ හරියට කරනවා – විදුලි බල සාමාන්‍යාධිකාරි ආචාර්ය සුසන්ත
තමා සදාකාලිකව විදුලි බල මණ්ඩලයේ සාමාන්‍යාධිකාරි තනතුරේ සිටිමට පැමිණියේ නැති බව විදුලි බල සාමාන්‍යාධිකාරි ආචාර්ය සුසන්ත පෙරේරා මහතා පවසයි.
ඒ් මහතා මේ බව පැවසුවේ අද (18) සිය පත්විම ගෙන පැවැති මාධ්‍ය හමුවේදිය.ඒහිදී ඔහු කියා සිටියේ තමාට ලැබුණ පත්වීම තාවකාලික බව දන්නා බවත් මෙවැනි තාවකාලික තනතුරු ගන්නා කිසිවෙකුත් අකමැති මොහොතක තමා මෙම තනතුර ගත් බවයි.
ආචාර්ය සුසන්ත පෙරේරා මහතා ලංකා විදුලිබල මණ්ඩලයේ සාමාන්‍යධිකාරී වශයෙන් පත්කිරීමට විදුලිබල මණ්ඩලයේ අධ්යක්ෂ මණ්ඩලය ගෙන ඇති තීරණය ගරු අහියචනාධිකරණය විසින් නියෝගකර ඇති පරිදි 1969 අංක 17 දරන ලංකා විදුලිබල මණ්ඩල පනතේ 5 (1) වගන්තියෙන් විදුලිබල මණ්ඩලයේ අධක්ෂ මණ්ඩලයට ලබාදී ඇති බලතල අනුව කරන ලද පත්වීමකි. විදුලිබල මණ්ඩලයේ අධක්ෂ මණ්ඩලය මෙම පත්වීම සිදුකර ඇත්තේ ගරු අහියාචනාධිකරණය විසින් ලබාදුන් නියෝගයට පුර්ණ වශයෙන් අනුකූලව සහ එකී නියෝගය සම්බන්ධයෙන් ගරු නීතිපතිතුමා සහ අදාල නඩුවේ අනෙකුත් පාර්ශ්වකරුවන් වෙනුවෙන් පෙනී සිටි ජනාධිපති නීතිඥවරුන් විසින් ලබාදුන් වැඩිදුර පැහැදිලිකිරීම් හා උපදෙස් සලකා බැලීමෙන් අනතුරුවය.
මෙම නියෝගය ලංකා විදුලිබල මණ්ඩල පනතේ ඇති වෙනත් වගන්තියක් සමග කියවිය යුතු බවට ගරු අහියාචනාධිකරණය විසින් සිය නියෝගයෙනේ නියම කර නොමැත. එසේ කළ යුතු බවට නීතිපතිතුමා විසින්ද උපදෙස් දී නොමැත. මෙම තාවකාලික පත්වීම සඳහා තෝරාගනු ලබන පුද්ගලයා වයස හැට නොඉක්මවිය යුතු බව හෝ එම පත්කිරීම විදුලිබල මණ්ඩල පනතේ 5 (4) වගන්තියට යටත්විය යුතු බව අධිකරණ නියෝගයේ සඳහන්ව නොමැත. එකී නියෝගයෙන් කියවෙනුයේ ලංකා විදුලිබල මණ්ඩල පනතේ 5 (1) වගන්තියෙන් විදුලිබල මණ්ඩලයේ අධක්ෂ මණ්ඩලයට ලබාදී ඇති බලතල අනුව අදාළ පත්වීම තාවකාලික පදනම මත සිදු කරන ලෙස පමණි.
එසේම ගරු අහියාචනාධිකරණය විසින් විදුලිබල මණ්ඩලයේ අධක්ෂ මණ්ඩලය වෙත ලබා දී ඇත්තේ අනතුරු තහනම් නියෝගයකි. අදාල නඩුව අසා තීන්දුවක් දෙනතෙක් මෙම නියෝගය ක්‍රියාත්මකවන බව එකී නියෝගයේ පැහැදිලිව දක්වා තිබේ.
විදුලිබල මණ්ඩල පනතේ 5 (1) වගන්තියෙන් සාමාන්‍යධිකාරී පත්කිරීම විෂයභාර අමාත්‍යවරයාගේ අනුමැතියට යටත්විය යුතු බව සඳහන් වේ. එහෙත් මෙම අනුමැතිය ලිඛිතව ලබා ගැනීම අනිවාර්ය නොවේ. ඒ අනුව විදුලිබල මණ්ඩලයේ සභාපතිතුමා විසින් ආචාර්ය සුසන්ත පෙරේරා මහතා ලංකා විදුලිබල මණ්ඩලයේ සාමාන්‍යධිකාරී වශයෙන් පත්කිරීමට විදුලිබල අමාත්‍ය ගරු ගාමිණි ලොකුගේ මහතාගේ අනුමැතිය දුරකථනය මගින් ලබාගත් බව ප්‍රකාශ කර ඇත.
ඉහත කරුණු අනුව ආචාර්ය සුසන්ත පෙරේරා මහතා ලංකා විදුලිබල මණ්ඩලයේ වැඩබලන සාමාන්‍යාධිකාරි වශයෙන් තාවකාලික පදනම මත පත්කිරීම නීති විරෝධී බවට ඇතැම් පාර්ශ්වයන් නගන චෝදනාව පදනම් රහිත බව සඳහන් කල යුතුය. එසේම, ආචාර්ය සුසන්ත පෙරේරා මෙම තනතුර දැරීම සඳහා අවශ්‍ය සුදුසුකම්, දක්ෂතාවයන් සහ ක්ෂේත්රයේ අත්දැකීම් ඇති පරිනත ඉංජිනේරුවකු වේ.
ආචාර්ය සුසන්ත පෙරේරා මහතා කොළඹ රාජකීය විද්‍යාලයෙන් මුලික අධ්‍යාපනය ලබා ඉංජිනේරු උපාධිය හැදෑරීම සඳහා 1979 වසරේදී මොරටුව විශ්ව විද්‍යාලයට ඇතුලත්ව 1983 වර්ෂයේදී B.Sc. ඉංජිනේරු උපාධිය සමත් වී ඇත. විදුලි ඉංජිනේරුවකු වශයෙන් 1984 අප්‍රියෙල් මස ලංකා විදුලිබල මණ්ඩලයට බැඳුනු ඔහු 1989 වසරේදී අචාර්ය උපාධිය හැදෑරීම සඳහා ඇමෙරිකා එක්සත් ජනපදයේ පෙන්සිල්වනියා විශ්ව විද්‍යාලයට (University of Pennsylvania) ඇතුලත්වී ඇත. බලශක්ති කළමනාකරණය හා ප්‍රතිපත්ති විෂය සම්බන්ධයෙන් ආචාර්ය උපාධිය නිම කිරීමෙන් පසු නැවත ලංකා විදුලිබල මණ්ඩලයේ සේවයට පැමිණි ආචාර්ය සුසන්ත පෙරේරා මහතා 2020 නොවැම්බර් මස අතිරේක සාමාන්‍යධිකාරී (සම්ප්‍රේෂණ) තනතුරින් විශ්රාම ගන්නා ලදී. ඉන් පසුව වර්තමාන තනතුරට පත්වන තෙක් විදුලිබල අමාත්‍යංශයේ අතිරේක ලේකම්වරයකු වශයෙන් සේවය කරන ලදී.
මේ අනුව, විදුලිබල ක්ෂේත්රයේ වසර 37කට ආසන්න අත්දැකීම ඇති ආචාර්ය සුසන්ත පෙරේරා මහතාව විදුලිබල මණ්ඩලයේ සාමාන්‍යාධිකාරි තනතුරේ වැඩ බැලීම සඳහා පත්කිරීමට මණ්ඩලයේ අධ්යක්ෂ මණ්ඩලය විසින් ගනා ලද තීරණය ඉතාමත් සාධනීය පියවරක් වේ. මෙවන් අර්බුධකාරී තත්ත්වයක් යටතේ විදුලිබල මණ්ඩලය මෙහෙයවීමට සහ එහි අධ්යක්ෂ මණ්ඩලයට අවශ්‍ය මග පෙන්වීම ලබා දීමට සුදුසුකම් සහ දීර්ඝ අත්දැකීම් ඇති ආචාර්ය සුසන්ත පෙරේරා වැන්නකු මෙම තතුරට පත්කිරීම කාලෝචිත තීරණයක් බව සඳහන් කල යුතුය.
Pursuant to the order of the Court of Appeal dated January 12, 2022, the Board of CEB has appointed Dr. M. N. Susantha Perera as the Acting General Manager of CEB on temporary basis in terms of powers vested in the Board under clause 5 (1) of the Ceylon Electricity Board Act, No. 17 of 1969. The Board has taken this decision having considered the opinion of the Hon. Attorney General and the President’s Counsel appearing for the parties to the court case, and in full compliance with the order of the Court of Appeal.
The Court order does not state that it should be read in conjunction with any other provisions in the CEB Act. Nor has the Hon. Attorney General instructed the Board to do so. The Court order does not specify that the age of the person selected for appointment as the General Manager on temporary basis should be below 60 years, or the said appointment should be subject to clause 5 (4) of the CEB Act. The Court Order states clearly that the Board should make the said appointment on temporary basis under powers vested in the Board by clause 5 (1) of the CEB Act.
The order of the Court of Appeal is an interim order that will remain in force until the final determination of the case.
Clause 5 (1) of the CEB Act states that the appointment of General Manager by the Board should be subject to the approval of the Minister. However, it does not specify that such approval should be given in writing. The Chairman of CEB has stated that he obtained the Minister’s approval to appoint Dr. Perera over telephone.
It is clear from the foregoing that there is no basis for the allegation by some parties that Dr. Susantha Perera’s appointment to the post of General Manager of CEB is illegal.
Dr. M. N. Susantha Perera is eminently suited to be appointed as the General Manager of CEB both in terms of academic qualifications and industry experience of over 36 years. Dr. Perera received his primary education at Royal College Colombo and entered the University of Moratuwa in 1979. After obtaining the B.Sc. (Engineering) degree in 1983, he joined the Ceylon Electricity Board on April 1984 as an electrical engineer. He was admitted to the University of Pennsylvania, a prestigious university in the United States, to read for his doctorate in Energy Management and Policy. He returned to the CEB service after completing his doctoral studies at the University of Pennsylvania and remained there until his retirement in November 2020 as the Additional General Manager (Transmission). Thereafter, he served in the Ministry of Power as Additional Secretary (Technical) until his current appointment to the post of General Manager of the CEB.
The appointment of an experienced engineer of the caliber of Dr. Perera as the General Manager of CEB is a prudent and timely decision taken by the Board of CEB. He has the ability and a proven track record as well as academic credentials to hold the reins of the CEB and provide necessary guidance to the Board to make some positive changes towards overcoming multiple crises faced by the CEB at present.
